ACCC authorises concrete cartage owner drivers collective bargaining
The Australian Competition and Consumer Commission has granted authorisation for owner drivers providing concrete cartage services to collectively bargain with Q-crete.
Q-crete is a Brisbane based concrete supplier that employs the services of 10 owner drivers to deliver concrete. Q-crete also has some employee drivers. However these employee drivers are not part of the proposed collective bargaining group.
“The collective bargaining arrangements are likely to result in transaction cost savings and provide the opportunity for increased owner driver input into contracts,” ACCC chairman Graeme Samuel said.
The arrangements are unlikely to restrict competition as they are limited in scope to 10 owner drivers and are voluntary for both the drivers and Q-Crete.
Authorisation provides immunity from court action for conduct that might otherwise raise concerns under the competition provisions of the Competition and Consumer Act 2010. Broadly, the ACCC may grant an authorisation when it is satisfied that the public benefit from the conduct outweighs any public detriment.

ACCC allows owner drivers in South-East Queensland to …
Owner drivers have been granted authorisation to enable them to collectively negotiate the terms and conditions upon which they provide earthmoving services in the commercial and civil construction sectors in south-east Queensland.
Owner drivers contract with earthmoving companies to pick up and deliver materials to and from construction sites. Most operate as small businesses and are engaged on a job-by-job basis.
The Construction, Forestry, Mining & Energy, Industrial Union of Employees, Queensland (CFMEU Qld) will provide support services to facilitate the collective negotiations. It will not conduct negotiations on behalf of the owner drivers.
Authorisation provides protection from court action for conduct or arrangements that might otherwise raise concerns under the competition provisions of the Trade Practices Act 1974. Authorisation is granted where the ACCC is satisfied that the benefit to the public from the conduct outweighs any public detriment.
“The ACCC is satisfied that the proposed collective negotiations will result in a public benefit by enabling participating owner drivers to potentially have greater input into terms and conditions than would be the case if they were to deal individually with earthmoving contractors,” ACCC Chairman, Mr Graeme Samuel said.
“The ACCC considers that the associated public detriment is limited because participation in the collective negotiations is voluntary, given the absence of any collective boycott conduct and the current small size of the group.”
Earthmoving contractors remain able to choose whether or not to deal with the group.
“To ensure that the collective bargaining arrangements continue to be genuinely voluntary for earthmoving contractors, the ACCC has required the CFMEU Qld to regularly inform the ACCC of, among other things, the number of participating owner drivers,” Mr Samuel said.
“This information will assist the ACCC to monitor any growth in the size of the group which may be grounds for a review of the authorisation if it impacts on the ability of earthmoving contractors to choose whether to deal with the group or not.”
The ACCC’s determination will be available from the ACCC website.

This incident happened on 8/10/12 11:37pm at Julia Vargas St., Ortigas, right next to Home Depot. It was raining that night and as expected, there was heavy traffic on the road. It was described as bumper-to-bumper traffic when a taxi allegedly tapped the rear end of a gold Toyota sedan. The damage was obviously not that serious since all the cars were moving at a very slow pace. A scratch on the rear bumper of the sedan had to be the worst case.
Just a minor accident that two adults could solve with a simple and peaceful agreement right? Not quite. A guy wearing a white shirt (most probably the owner of the sedan) got off the car seconds after the accident and walks right to the door of the taxi driver. Assuming that he simply wanted to talk to the driver to get his contact information and driver s license so they can sort it out, my friend just carefully watch on. Suddenly he opens the door of the taxi and starts slapping the taxi driver while yelling at him. At this point, the tension escalated to a serious level and my friend began to film the person.
In the video, you can see the frustrated person yelling at the taxi driver while continuously slapping him through the opened door. The taxi driver makes an attempt to push the person back with his leg and the other person furiously answers back with a punch. After the exchange, it seems like the taxi driver tries to go down but the other person puts force on the door and closes it. Meanwhile, another person (possibly the driver of the guy in a white shirt) has opened the door on the other side of the taxi and starts threatening the taxi driver. By this time, the guy in a white shirt already looks like his head is going to burst but he constantly barks at the driver.
So there you go. Situations like these and that of Robert Carabuena aren t really uncommon at all. The question that needs to be answered is why are some Filipinos so short-tempered when everyone knows the situation of the traffic in Manila? Why do some people think that taking out their anger at one person can be justified at all? It s not as if that single person is the cause of all the traffic which not only he/she is affected. One thing is for sure, people who let their anger and temper get the best of them should not be tolerated. Luckily, at the end of the video (1:14) my friend got a glimpse of the plate number of the sedan. The video taker doesn t know what happened afterwards but we re hoping that this incident was reported to the police.
