A total of 8,400 payroll jobs were added to the for-hire trucking industry s payroll in November the first real jump since the spring of this year, coming on the heels of about six months of stagnant or no growth in the trucking employment. The seasonally adjusted numbers were issued Dec. 6 in the Bureau of Labor Statistics monthly employment report.
Moreover, October s preliminary employment numbers which said the trucking industry added 400 jobs in the month were upwardly revised to 2,400 added jobs.
The U.S. as a whole added 203,000 jobs in November, pushing the unemployment rate down to a 5-year low: 7 percent.
For-hire trucking industry employment rose in November to 1.3953 million 18,600 more than the same month in 2012 and 161,300 jobs higher than the industry s employment bottoming out in March 2010. However, it s still 58,100 jobs shy of January 2007 s high mark.
The BLS numbers for trucking reflect all payroll employment in for-hire trucking, but they don t include trucking-related jobs in other industries, such as a truck driver for a private fleet. Nor do the numbers reflect the total amount of hiring since they only reflect the number of employees paid during a specified payroll period during the month.
Due to high turnover rates, the BLS estimates may overstate the number of job positions due to the methodology used in the agency s Current Employment Survey.
Only 1 percent of the affected class members in the proposed settlement reached by Pilot Flying J1 and plaintiffs to settle the alleged fuel rebate withholding scam have chosen to opt out to pursue other legal action, according to a court document filed in a U.S. District Court in Arkansas this week.
The filing asks for the class-action settlement to be stamped for final approval by the court, as, in addition to the 1 percent opt-out rate, no members of the class filed an objection with the court, according to Pilot s request, which calls the settlement fair, adequate and reasonable for the class the criteria the court set for approving the settlement.
The company submitted a petition earlier this moth2 seeking approval of the settlement s figures a $72 million deal that would award $55 million to trucking companies for money owed in unpaid fuel rebates, $4.1 million in interest on that money owed, $3.5 million for auditing costs and up to $14 million for attorney s fees, though that number could be smaller in the end, Pilot says.
The request for final approval, like the petition for preliminary approval, says that 59 companies have opted out3, meaning that nearly 6,000 trucking companies were included in the class-action settlement and presumably had fuel rebates withheld by Pilot.
A fairness hearing to decide the fate of the settlement is set for Monday, Nov. 25.
Pilot was actually hit with another lawsuit this week, filed by Moore Freight Service out of Tennessee. The carrier, like the other two dozen or so lawsuits5 against the truck stop giant, is suing for conversion, fraud, violation of consumer protection laws, breach of contract and is seeking damages and attorney s fees.
Pilot s Knoxville headquarters were raided by federal agents April 156 to seize documents and electronic evidence. The same week, a federal affidavit was unsealed7 that detailed an alleged scheme in which Pilot and its sales staff systematically and intentionally cheated customers out of owed fuel rebates in order to boost company profits and sales staff commissions.
Pilot CEO Jimmy Haslam who has maintained throughout that he was9 not aware the scheme was occurring unveiled a plan in May10 to pay any owed funds to its customers and prevent the withholding from occurring in the future.

The for-hire industry has seen little gain in overall employment since April, according to BLS data.
Also in October, the U.S. economy as a whole added 204,000 jobs, but the unemployment rate dropped from 7.2 percent to 7.3 percent, due in part to the October partial government shutdown. Also, August and September numbers were upwardly revised by 60,000 jobs.
The for-hire trucking industry now has 1.3849 million payroll jobs up 22,000 (1.6 percent) from the same month in 2012. Trucking employment is up 150,900 jobs (12.2 percent) since March 2010 s bottom, but is down 68,500 jobs (4.7 percent) from January 2007 s high.
The BLS data only reflects the number of payroll employees and due to high turnover rate in trucking may overstate the number of job positions. It also does not reflect any employment in private trucking fleets.

The authors of the study, led by Edmarlon Girotto of the State University of Londrina in Brazil, analyzed data from 36 surveys and drug tests administered since 2000 in countries with long-haul trucking, like Australia, the U.S., and Brazil.
According to their research, the most frequent substance that truck drivers have been using and abusing are alcohol, amphetamines, cannabis, and cocaine. The truckers that are at the greatest risk for drug abuse are younger drivers, and those who are taking longer trips later at night.
In 2010, approximately 80,000 people were injured in crashes involving large trucks, and another 3,675 people were killed.
The drivers whose pay rate is determined by their productivity were also more likely to use drugs which makes sense: If you ll make more money by getting your cargo to its destination faster, you re more likely to think it s worth it to skip necessary hours of sleep, and you might therefore be more likely to need some (illegal and ill-advised) help staying awake.
It s an incredibly dangerous combination of factors, not just for the truckers but for everyone on the road as well. The authors of the study argue that it is imperative that everyone involved in the trucking industry be aware of this problem and work to resolve it. “Psychoactive substances have been proved to impair driving and cause a greater risk of traffic accidents,” the authors write. “Therefore gas stations, trucker stops and companies that employ these professionals must be more closely observed regarding the sale and consumption of these substances.”
In an editorial based on the study, Allard van der Beek of VU University in Amsterdam writes that low pay and extremely long hours have increasingly become the norm in the trucking industry. Both road transport companies and truck drivers benefit financially from these long working hours, writes van der Beek.
According to the latest data analyzed3 by the National Highway Traffic Safety Administration, in 2010, approximately 80,000 people were injured in crashes involving large trucks, and another 3,675 people were killed. Of those fatalities, 14 percent of them were drivers or passengers of the trucks, and 86 percent were other drivers on the road. The latest “Large Truck Crash Causation Study4” by the Federal Motor Carrier Safety Administration found that, in crashes involving large trucks, driver behavior was 10 times more likely to be at fault than other factors like bad weather or road conditions. At the conclusion of the study the FMCSA pledged5 to conduct more analysis on certain driver-behavior factors, including the abuse of prescription and over-the-counter drugs.
As van der Beek writes, it may be that the methods of the business are so ingrained that changing the entire culture will be an uphill battle. But if not now, when?

Many truck drivers operate safely, give to their communities and work to enhance the image of trucking. Now is the time nominate such drivers for the 2013 Driver of the Year Competition, run by the Truckload Carriers Association and Overdrive.
Three finalists for Owner-Operator of the Year and Company Driver of the Year will be announced in December. The six finalists will attend TCA s annual meeting, March 23-26, near Dallas, where the winners will be announced.
All nominees must have at least one million consecutive, accident-free miles. Company drivers must be nominated by the carrier that employs them. Owner-operators may be nominated by a carrier they have been leased to for three or more years, or if independent they can nominate themselves or be nominated by a spouse.
Nominations will be accepted until Oct. 21.
